How to Understand the Reasons for Your Canada Visa Rejection?

During different stages of the immigration process to Canada, your application may be rejected by IRCC officers for various reasons. If your application has been refused or delayed, it is better to obtain more detailed information about your case. To do this, you can request GCMS/ATIP notes. These notes contain many details about the review process of your application by immigration officers.

One of the most important benefits of obtaining officer notes is gaining insight into the reasons for your application refusal. By studying these notes, you can fully understand your case’s status and make necessary improvements. If your application has been rejected or delayed, we recommend reading our short article on how to request Canadian officer notes.

Officer notes, also known as GCMS notes, contain important information, including details of how your case was reviewed by immigration officers. By obtaining these notes, you can understand the exact reasons for your rejection.

Requesting officer notes from Canada is done under the Access to Information and Privacy (ATIP) Act. To request these notes, you can apply through the Immigration, Refugees, and Citizenship Canada (IRCC) website.

The online ATIP request fee on the IRCC website is 5 Canadian dollars, which can be paid using valid bank cards.

Difference Between GCMS and ATIP

ATIP (Access to Information and Privacy Act) is a federal law in Canada that allows citizens and permanent residents to access their records held by government agencies. This law was enacted to promote transparency and protect individuals’ privacy. Through this law, individuals can request access to information collected and maintained by government institutions.

GCMS (Global Case Management System) is a case management system used by the Canadian government to manage immigration and visa application records. This system contains all applicants’ immigration-related data, including officer notes, communications, submitted documents, and decisions related to cases.

Key Differences Between GCMS and ATIP:

GCMS:

  • Database: A case management system that includes all details of applicants’ immigration applications.
  • Notes: GCMS notes include all inputs and details recorded during the immigration application review process, including officer assessments and decisions.
  • Content: Contains detailed information about applications, including the history of correspondence, submitted documents, and decisions made.

ATIP:

  • Law: A Canadian law that gives individuals the right to access their records and government-held information.
  • Purpose: To facilitate access to personal records while protecting privacy.

Practical Example:

Imagine you have applied for immigration to Canada and want to know your application status and the decisions made by the immigration officer. You can submit an ATIP request to access your GCMS notes. These notes will include all details of your application, such as officer comments, assessments, communications, and submitted documents.

Thus, ATIP is a legal tool that allows you to access information stored in GCMS. GCMS, as a case management system, stores all data related to immigration applications, while ATIP allows individuals to retrieve this information.

Who Is Eligible to Request Officer Notes?

To be eligible to request Canadian officer notes under the ATIP Act, you must meet one of the following three conditions:

  • Be a Canadian citizen
  • Be a Canadian permanent resident
  • Be an individual or company currently present in Canada

Applicants outside Canada can request ATIP notes through a representative who is a Canadian citizen or permanent resident or a company operating in Canada. The representative must submit the request after the applicant signs a consent form.

What Documents Are Required to Request Canadian Officer Notes?

  1. Application Number: To submit an ATIP request and receive officer notes, you must provide your Application Number.
  2. Unique Client Identifier (UCI): Your UCI number is also requested, but it is not mandatory.

The Application Number is assigned as soon as an immigration application is submitted to IRCC. It consists of one letter followed by a series of numbers (usually 9 digits). You can find this number in your submission confirmation letter, biometric request letter, or rejection letter.

The UCI number is issued only after IRCC starts processing your application and is unique to each individual.

How Long Does It Take to Receive Officer Notes?

Processing officer notes requests typically takes a few weeks. Once processed, the officer notes will be sent to you.

After receiving the notes, you can carefully review the reasons for your visa refusal and, if necessary, consult an immigration lawyer or expert to improve your next application.
